Terms of Service

1. Agreement to Terms

By accessing or using Profitable ("profitable.app"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time and will notify you of material changes via email or through the Service.

2. Description of Service

Profitable is a market intelligence platform that tracks digital marketplaces including Chrome extensions, Shopify apps, WordPress plugins, Google Workspace apps, and other datasets. The Service provides aggregated, publicly available marketplace data to help users identify market opportunities.

3. Accounts

To access paid features, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at hello@profitable.app if you suspect unauthorized access.

4. Subscriptions and Payments

Paid access is offered on a subscription basis (monthly or annual). Payments are processed by our merchant of record, Creem ("creem.io"), who handles billing, sales tax, and payment processing on our behalf. By subscribing, you also agree to Creem's terms of service as the merchant of record.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.

5. Refunds

If you are not satisfied with the Service, you may request a refund within 14 days of your initial purchase by contacting hello@profitable.app. Refunds are not available for renewal charges. We reserve the right to deny refund requests in cases of abuse.

6. Acceptable Use

You agree not to:

• Resell, redistribute, or sublicense access to the Service or its data
• Systematically scrape, crawl, or extract data from the Service beyond normal use
• Share your account credentials or API keys with third parties
• Use the Service for any unlawful purpose
• Attempt to interfere with or compromise the Service's infrastructure
• Circumvent any access restrictions or rate limits

7. MCP Server and AI Assistant

Paid subscribers may receive access to our MCP server (for use with AI agents such as Claude) and our built-in AI assistant. Access credentials are personal to your account and must not be shared. We enforce rate limits to ensure fair usage. Excessive or abusive usage may result in throttling or suspension of access.

The AI assistant and MCP server may generate responses based on our marketplace data. These outputs are for informational purposes and should not be treated as professional advice.

8. Data and Accuracy

The data provided through the Service is aggregated from publicly available sources and is provided on an "as is" basis. While we strive for accuracy, we do not guarantee that data is complete, current, or error-free. You should not rely solely on our data for business decisions.

9. Intellectual Property

The Service, including its design, features, and aggregated datasets, is owned by Profitable. You retain no intellectual property rights over the data or the Service. You may use data obtained through the Service for your own research and business purposes but may not republish or resell it.

10. Limitation of Liability

To the maximum extent permitted by law, Profitable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to access the Service ceases immediately. You may terminate your account at any time by cancelling your subscription and contacting us.

12. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.
